Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Long Island Laser Engraving website and any related services (collectively, the "Services"). By accessing the site, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Accounts

You are responsible for the accuracy of information you provide and for safeguarding your login credentials. You are responsible for all activity that occurs under your account. Notify us immediately at orders@longislandlaserengraving.com if you suspect unauthorized access.

3. Orders and Pricing

All orders are subject to acceptance. We may refuse or cancel any order at our discretion, including if the order appears fraudulent, if pricing was incorrectly listed, or if the artwork submitted violates these Terms. Prices are listed in U.S. dollars and may change at any time. The price you pay is the price displayed at checkout when you complete the transaction.

Every job is subject to a $7 minimum. Per-square-inch pricing above the minimum is calculated from the material category and the engraved area. Sales tax is applied to orders shipped to states where we are required to collect it. Shipping charges are calculated at checkout.

4. Payment

Payments are processed by Square. By placing an order, you authorize us to charge your payment method for the total order amount including taxes and shipping. Card details are entered directly into Square and are never stored on our servers.

5. Artwork, Files, and Intellectual Property

You retain all intellectual property rights in artwork you upload. By submitting artwork, you represent and warrant that you either own the artwork or have all necessary licenses, rights, consents, and permissions to use it for the purpose of engraving the requested products.

You grant us a limited, non-exclusive license to use your artwork solely to fulfill your order, including engraving, re-engraving on reorder, internal quality control, and customer service. We do not use your artwork for marketing without your explicit consent.

You agree to indemnify and hold Long Island Laser Engraving harmless from any claims, damages, or expenses arising from infringement of third-party intellectual property rights, publicity rights, or other rights in any artwork you submit. We reserve the right to refuse to engrave artwork that we reasonably believe infringes the rights of others or violates applicable law.

6. File Requirements and Production

Engraving quality depends on the quality of the file you submit. We recommend vector files (SVG, AI, PDF, EPS) for crisp edges. High-resolution PNG and JPG are also accepted. We do not edit or correct your files unless explicitly requested and quoted. Engraving results vary based on material, finish, and source artwork.

We confirm production turnaround when we send the order confirmation or quote. We are not responsible for delays caused by file issues, payment problems, or events beyond our reasonable control.

7. Shipping and Risk of Loss

Title and risk of loss pass to you when the carrier accepts the shipment from us. Delivery dates are estimates and not guaranteed. We are not responsible for carrier delays. If a package is lost or damaged in transit, contact us and we will help you file a claim with the carrier. For customer-supplied items, you are responsible for shipping the item to us safely and for return shipping costs.

8. Returns and Refunds

Custom-engraved products are made to your specifications and are not eligible for return unless they are defective or differ materially from what was ordered. If your order arrives defective or incorrect, contact us within 7 days of delivery with photos of the issue and we will replace, refund, or credit your order at our discretion.

For customer-supplied items, we are not liable for damage to the item beyond the original engraving area unless caused by our negligence. We recommend approving a proof before final engraving on high-value or one-of-a-kind items.

9. Prohibited Conduct

You agree not to use the Services to:

• Upload or order artwork that infringes intellectual property, publicity, or privacy rights of others.
• Upload artwork that depicts unlawful, hateful, harassing, sexually explicit, or otherwise objectionable content as determined by us in our sole discretion.
• Attempt to circumvent payment, fraud detection, or account security mechanisms.
• Reverse-engineer, scrape, or interfere with the operation of the Services.
• Use the Services to compete with us or to develop a competing product.

10. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure. To the extent allowed by law, all implied warranties are disclaimed.

11. Limitation of Liability

To the maximum extent permitted by law, Long Island Laser Engraving and its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost data, arising out of or related to the Services or any order. Our total liability for any claim arising out of or relating to the Services or any order shall not exceed the amount you paid us for the order giving rise to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Long Island Laser Engraving from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Services, your artwork, your violation of these Terms, or your violation of any third-party right.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Suffolk County, New York, and you consent to personal jurisdiction in those courts.

14. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. Material changes will be communicated by email or a prominent notice on the site. Continued use of the Services after a change constitutes acceptance of the updated Terms.
